Refund Policy for SOL Sound of Life Media LLC (dba C.A.R.B.-Verse, SOL Music, SOLTV, SOL Shopping Network, and Affiliates)

This Refund Policy applies to all services, products, and transactions conducted via SOL Sound of Life Media LLC platforms, including but not limited to C.A.R.B.-Verse, SOL Music, SOLTV, and SOL Shopping Network (collectively referred to as “SOL Entities”). By using our services, you agree to the terms outlined in this Refund Policy.

General Refund Policy

1. Digital Goods and Services

Due to the nature of digital goods and services offered by SOL Entities, including NFT-related transactions, music content, video services, and subscriptions:

  • All sales are final. Digital content, including but not limited to downloadable files, NFTs, and streaming services, cannot be returned or refunded once accessed, minted, purchased, or downloaded.

  • Refunds will only be issued in the event of proven technical errors directly attributable to SOL Entities, and only if these errors prevent the user from accessing a purchased product or service.

2. NFT Transactions

NFTs (non-fungible tokens) associated with SOL Entities, including but not limited to C.A.R.B.-Verse NFTs, are facilitated by third-party platforms such as OpenSea.

  • Responsibility for OpenSea Transactions: SOL Entities do not control the infrastructure, transactions, or wallets used in the OpenSea ecosystem. Therefore:

    • All issues, disputes, or errors related to OpenSea transactions, including failed transactions, wallet security, or blockchain-related errors, are the sole responsibility of OpenSea and the wallet owner.

    • Users must refer to OpenSea's terms of service and refund policies for any NFT-related disputes or requests.

  • Minting Errors: In the rare event that a minting error occurs directly attributable to SOL Entities (not OpenSea or the blockchain), SOL may, at its sole discretion, offer a replacement NFT of equal value. No monetary refunds will be issued for minting errors.

  • No Warranty for Value Fluctuations: NFTs are speculative assets subject to market volatility. SOL Entities are not responsible for the market value, perceived value, or resale value of NFTs after purchase.

  • Waiver of Liability: By purchasing or minting NFTs associated with SOL Entities, you acknowledge and accept the risks of blockchain technology and agree to hold SOL Entities, its affiliates, executives, and business partners harmless for any issues arising from third-party services, wallet security, or blockchain functionality.

3. Subscriptions and Memberships

For subscription-based services offered by SOL Entities, such as SOLTV or SOL Music:

  • Refunds for subscription fees will only be issued if:

    • The subscription was canceled before its renewal date but the user was still charged.

    • A technical issue attributable to SOL prevented access to the subscription service.

  • Partial refunds for mid-cycle cancellations or unused periods will not be issued. Users must cancel subscriptions before the renewal date to avoid additional charges.

4. Physical Goods

For physical goods purchased via SOL Shopping Network:

  • Refunds or exchanges are only available for defective or damaged items.

  • Refund requests must be submitted within 30 days of receiving the item.

  • Returned items must be unused, in their original packaging, and accompanied by proof of purchase.

Note: Shipping fees are non-refundable, and users are responsible for return shipping costs unless the item was defective upon arrival.

5. Events, Promotions, and Limited-Time Offers

Refunds are not available for purchases made as part of limited-time offers, sales, promotions, or exclusive events unless required by applicable law.

6. Chargebacks

Unauthorized chargebacks will be treated as a breach of this Refund Policy. If SOL Entities determine a chargeback is invalid, we reserve the right to:

  • Terminate or suspend the associated account.

  • Pursue legal remedies to recover funds.

7. Limitations of Liability

  • No Guarantee of Performance or Access: SOL Entities are not responsible for interruptions, delays, or failures caused by external systems, including but not limited to blockchain networks, OpenSea infrastructure, or third-party payment gateways.

  • Indemnity Clause: By using our services, you agree to indemnify and hold harmless SOL Entities, their affiliates, executives, and business partners from any claims, damages, or losses arising from:

    • Technical failures beyond SOL’s control.

    • User error, negligence, or failure to maintain secure access to wallets, accounts, or devices.

    • Actions or omissions by third-party service providers (e.g., OpenSea, payment processors).

8. Compliance with California Law

This Refund Policy is governed by the laws of the State of California. While we strive to provide the highest level of service and transparency, this policy does not waive any rights you may have under applicable consumer protection laws in California or elsewhere.

9. EU Consumer Rights (GDPR and MiCA Compliance)

For EU residents, this Refund Policy complies with the General Data Protection Regulation (GDPR) and Markets in Crypto-Assets Regulation (MiCA):

  • Refund requests for digital goods must meet EU statutory requirements, including proving a technical defect directly attributable to SOL Entities.

  • SOL Entities are not responsible for NFT-related disputes arising from blockchain-based transactions facilitated through third parties, as such transactions fall outside the scope of MiCA’s issuer obligations.

  • Users may withdraw consent for subscription services or personal data processing under GDPR but acknowledge that withdrawal does not entitle them to retroactive refunds.

10. Updates to This Policy

This Refund Policy may be updated periodically to reflect changes in business practices or legal requirements. Any material changes will be communicated via email or updated on our platforms.
